ADDITIONAL COST FOR SERVICES ARE ANYWHERE BETWEEN 10 TO 20 PERCENT OR MORE, DEPENDING ON ON VARIOUS VARIOUS FACTORS. AND SO NOT TO MENTION JUST THE TIMELINE AND CONSTRAINTS IN ORDER TO GET THAT DONE. ONE BIG DRIVER THAT IS IMPACTING CITIES ABILITY TO MEANINGFULLY IMPLEMENT THE RECYCLING REQUIREMENTS THAT THE CITY HAS PUT FORTH IS JUST THE FACT THAT THE EXPORT OF RECYCLABLES HAS BEEN DIMINISHED AND LIMITED ALMOST ENTIRELY. THEY USED TO BE SHIPPED OVERSEAS TO CHINA, AND CHINA HAS SINCE CUT BACK AND STOPPED A LOT OF THE RECYCLING RECYCLABLES THAT THEY WERE COLLECTING. ASIDE FROM THAT, IT'S JUST THE PROCESSING LOCATIONS FOR RECYCLABLES. AND NOW WITH THE INFLUX OF NEW REGULATIONS ARE GOING TO REQUIRE A HIGHER LEVEL. AND COMPLEXITY TO RECYCLING IS JUST A LACK OF PROCESSORS AND HAULERS THAT ARE CAPABLE OF MEETING THAT DEMAND AND NEEDS. AND SO ALL THAT JUST ADDS ADDED PRESSURE TO THE FINANCIAL, I GUESS, FINANCIAL SITUATION THAT IMPACTS FEES RELATED TO THAT. SO SOME OF THE OTHER BILLS, ABOUT THREE THREE TO. OK. AND SO IN IN THE GRANDER SCHEME, BIGGER PICTURE ISSUE, JUST WITH OUR SMALL STAFF IN MANY SMALL CITIES UP AND DOWN THE STATE, ANY ANY OF THESE LEGISLATIVE BILLS THAT ARE ATTACHED TO OUR FUNDING MECHANISMS CREATES A SIGNIFICANT ADMINISTRATIVE BURDEN THAT WE ADDS ON TO STAFFS ALREADY IN PLACE. AND CERTAINLY THIS HIGH SPEED RAIL PROJECT IS SOMETHING THAT THE STATE AS A WHOLE HAS BEEN NAVIGATING SINCE TWO THOUSAND EIGHT WHEN THE VOTERS APPROVED PROP 1A, WHICH PROVIDED THE INITIAL FUNDING FOR THIS PROJECT INITIALLY AT NINE POINT NINETY NINE POINT NINE FIVE [01:35:01] BILLION DOLLARS. THAT NUMBER, I BELIEVE, IS NOW I THINK TENFOLD THAT NOW, IF I REMEMBER CORRECTLY. AND SO IT'S JUST DRAMATICALLY INCREASED AS THIS PROJECT HAS FURTHER DEVELOP THE PROJECT ITSELF. THINK OF IT AS IT BEING STATEWIDE. IT IS IT IS VERY COMPLEX AS IT GOES THROUGH MULTIPLE AREAS FOR THE STATE. BUT RIGHT NOW, THE ONLY SECTION IS THAT IT'S BEING BUILT IS PRIMARILY THAT FRESNO, THE BAKERSFIELD PROJECT. WE WERE UNFORTUNATELY THE GUINEA PIG AS THIS PROJECT WAS BEING DEVELOPED WHERE WE WERE PART OF THAT FIRST SEGMENT. AND AND THERE'S A LOT OF I GUESS, A LOT OF LESSONS LEARNED, A LOT OF GROWING PAINS ASSOCIATED WITH THE PROJECT AS IT GOES THROUGH. AND UNFORTUNATELY, IT'S HAD A CONSEQUENCE AND DETRIMENT TO OUR COMMUNITY AS WE WE'VE BEEN HAVING TO NAVIGATE THAT. THIS IS REFERRED TO WHERE WITHIN OR WAS REFERRED TO THE CONSTRUCTION PACKAGE FOR WHICH IS A TWENTY TWO MILE SEGMENT THAT SPANS INTO THE KERN COUNTY LINE. YOU KNOW, PUT THAT IN PERSPECTIVE, THERE'S VARIOUS PROJECT OF THIS MAGNITUDE IN MOST PROJECTS IN CALIFORNIA REQUIRE A GREAT DEAL OF DUE DILIGENCE, AND MANY OF THOSE REQUIRE WHAT'S REFERRED TO AS AN ENVIRONMENTAL IMPACT STATEMENT OR AN ENVIRONMENTAL IMPACT REPORT. AND THAT IS THAT IS A BROAD LEVEL ASSESSMENT THAT FACTORS A NUMBER OF ENVIRONMENTAL ISSUES, CONSTRUCTION RELATED CONCERNS THAT WOULD IMPACT THE SURROUNDING AREA, AS WELL AS SOCIAL AND ECONOMIC ISSUES AND CONCERNS RELATED TO THAT. AND THE REALITY IS, AGAIN, THIS PROJECT STARTED IN TWO THOUSAND EIGHT. THE COUNCIL AND THE CITY MANAGEMENT AT THE TIME REALIZED ONCE THIS PROJECT WAS BEING DEVELOPED THAT THE PROJECT WAS GOING TO COME NEAR WASCO, IF NOT COME THROUGH WASCO. AND IN FACT, THE COUNCIL'S AT THE TIME DID IN FACT OPPOSE THE PROPOSED PLANS THAT WOULD [01:40:04] HAVE COME TO WASCO. THE COUNT, THE MAYORS AND COUNCIL MEMBERS AND THE CITY MANAGER TESTIFIED AT VARIOUS POINTS WITH THE HIGH SPEED RAIL AUTHORITY IN OPPOSITION TO THE PROJECT, CITING THE ISSUES THAT WOULD OCCUR. THE IMPACT THAT WE WOULD HAVE THAT WE ARE REALIZING TODAY. AND THE REALITY IS, IS THAT WASCO TO THE AUTHORITY AND THE STATES WAS A SMALL FISH THAT THEY COULD IGNORE. BUT THESE RESOLUTIONS CLEARLY SPELLED OUT IN SUPPORT OF BUILDING THE PROJECT AWAY FROM MOSCOW AND OR MITIGATING AND ADDRESSING THE NEGATIVE IMPACTS THAT WOULD OCCUR IN THE COMMUNITY THAT INCLUDED THE RESOLUTION IN 2011. THE RESOLUTION WAS IN SUPPORT OF DEVELOPING THE HIGH-SPEED RAIL ALIGNMENT ON THE EAST SIDE OF THE EXISTING BNSF RAIL ALIGNMENT'S. THE EAST SIDE OF THE ALIGNMENT'S WOULD HAVE SIGNIFICANTLY FEWER COMMUNITY IMPACTS TO THE COMMUNITY. AGAIN, THAT'S THAT'S THE LINE TO THE RIGHT THAT'S OUTSIDE OF THE CITIES, DEVELOPED AREAS. YOU GO BACK IN 2012, THE RESOLUTION WAS ADOPTED BY THE COUNCIL OPPOSING THE HIGH-SPEED RAIL PROJECT AS PROPOSED PROPOSAL BY MR. WASCO WOULD CONTAIN A COMPARABLE NEGATIVE IMPACT TO THE COMMUNITY PROPOSAL. LINEMAN'S WOULD DAMAGE SIGNIFICANT AMOUNTS OF LOCAL RESIDENCES, BUSINESSES, HISTORICAL STRUCTURES, CULTURALLY SIGNIFICANT STRUCTURES, OPEN SPACES TO OTHER BASIC CRITICAL INFRASTRUCTURE. FAST FORWARD 10 YEARS. WE ARE SEEING THAT THE RESOLUTION FROM 2015 OPPOSING THE HIGH-SPEED RAIL PROJECT AS PROPOSED AND REQUESTED RECONSIDERATION. OF A LESS DAMAGING ALTERNATIVES, SO THE CITY OPPOSED THIS AT EVERY STEP OF THE WAY. BUT OBVIOUSLY, YOU KNOW, WE'RE WE'RE A VERY SMALL ENTITY IN COMPARISON TO THE HIGH-SPEED RAIL AUTHORITY AS A WHOLE. YOU KNOW, CERTAINLY THERE IS A LOT OF COMPLEXITY, A LOT OF COMMUNICATION BACK AND FORTH AND PRESENTING OUR NEEDS. BUT ONE OF THEM WAS THE FACT THAT THE AUTHORITY DID IDENTIFY THAT THE LABOR CAMP WAS GOING TO BE WAS GOING TO BE A COMMUNITY, AN AREA ALONG THE PROJECT THAT THEY WOULD HAVE TO MITIGATE. AND THAT'S PART OF THAT. THERE WAS THE IDEA OR CONCEPTUALIZED AND ULTIMATELY APPROVED BY THE HIGH-SPEED RAIL AUTHORITY OF RELOCATING THE RESIDENTS IN LIEU OF DEVELOPING MORE COSTLY MITIGATION MEASURES SUCH AS SOUND WALLS, PEDESTRIAN IMPROVEMENTS FOR THE CROSSWALKS AT THE RAILROAD CROSSINGS. SO ESSENTIALLY, THE THE AUTHORITY WOULD SAVE MONEY BY SPENDING MONEY TO RELOCATE THOSE RESIDENTS. AND BACK ON ON MAY 10TH IN 2016, THEN MAYOR CHERYL WEGMANN AND THE CITY MANAGER AT THE TIME, PAUL PARIS, THEY SPOKE AND ADDRESSED THE BOARD OF DIRECTORS, THE HIGH SPEED RAIL BOARD OF DIRECTORS AUTHORITY REGARDING A PROPOSED PLAN THAT THE THAT THE AUTHORITY STAFF WAS ON BOARD IN THE FORM OF A MITIGATION AGREEMENT. AND THE BOARD OF DIRECTORS UNANIMOUSLY APPROVED THAT HIGH SPEED RAIL RESOLUTION THAT PROVIDED FOR THE AUTHORITY AND APPROVAL TO DELEGATE TO THE CHIEF EXECUTIVE OFFICER, THE CEO, TO NEGOTIATE AND EXECUTE A MITIGATION AGREEMENT WITH THE CITY OF WASCO. AND I KNOW THERE'S COMMENTS REGARDING ABOUT, WELL, NOW THERE'S GOING TO BE THE CITY HAD THIS AGREEMENT. WHY DID THE CITY THAT INCLUDED IN THERE? WELL, QUITE FRANKLY, I CAN'T TELL YOU WHAT WAS DISCUSSED BECAUSE I WASN'T HERE AT THE TIME AND THE MAJORITY OF THE COUNCIL WASN'T HERE AND WEREN'T PRIVY TO THOSE COMMUNICATIONS. SO I DON'T KNOW WHAT THE PREVIOUS CITY MANAGER, PREVIOUS MAYORS WILL SAY ABOUT THIS. BUT THE REALITY IS THE MITIGATION AGREEMENT WAS VERY SPECIFIC TO JUST RELOCATING THE RESIDENTS. BUT NOTHING IN THE AGREEMENT ACTUALLY SPECIFIES OR EVEN MAKES A MENTION THE WORD OF DEMOLITION IS NOT EVEN BROUGHT UP IN THAT AGREEMENT. AND SO AND THAT WAS SPECIFICALLY BECAUSE THE INITIAL FUNDING ASSOCIATED WITH THAT MITIGATION AGREEMENT WAS TIED TO WHAT WHAT FUNDS AND PARAMETERS THE AUTHORITY HAD AT THE TIME RELATED TO ENVIRONMENTAL MITIGATION. SO AS THE PROJECT BUDGETED AND WAS FUNDED, THEY ALLOCATED POTS OF MONEY FOR DIFFERENT ASPECTS OF THE PROJECT. YOU'RE TALKING ABOUT THE ENVIRONMENTAL REVIEW. YOU HAVE POTS OF MONEY FOR THAT. YOU HAD THE CONSTRUCTION DESIGN. YOU HAVE POTS OF MONEY FOR THAT, THE ENVIRONMENTAL MITIGATION. YOU HAD A POT OF MONEY FOR THAT. SO THEY JUST AT THE TIME, I AM ASSUMING THEY JUST DIDN'T HAVE ENOUGH MONEY IN THAT POT TO TO BE ABLE TO MITIGATE AND ADDRESS OR EVEN THINK OF THE DEALING, HOW TO MITIGATE THE IMPACT OF A VACANT FARM. WERE HOUSING COMPLEX, LIKE I SAID. THE AUTHORITY WAS AWARE OF THE CONDITION, THEY WERE AWARE OF THE IMPACT A PROJECT WAS GOING TO HAVE, AND SO PART OF THE ACTUAL CONTRACT LANGUAGE ACTUALLY SPECIFIED. YOU KNOW, IN 2014, THE AUTHORITY APPROVED THE FINAL ENVIRONMENTAL IMPACT REPORT, ENVIRONMENTAL IMPACT STATEMENT, COMMONLY REFERRED TO AS THE IRS FOR THE FRESNEL BAKERSFIELD SECTION. WITHIN THAT FINAL IRS AUTHORITY IDENTIFIED IN AFFORDABLE HOUSING DEVELOPMENTS, I.E., THE [01:45:05] WASCO FINALLY WERE HOUSING COMPLEX, CURRENTLY LOCATED IN THE EAST OF THE BNSF RAIL LINES ON J AND SIXTH STREET AS AN ENVIRONMENTAL JUSTICE COMMUNITY REQUIRING MITIGATION. THE PROPOSED MITIGATION IS THE LAW SCHOOL FARM LABOR HOUSING RELOCATION PROJECT, WHICH WOULD BUILD AND RELOCATE THE CURRENT COMMUNITY. NOW THAT'S THAT'S STRAIGHT FROM THAT MITIGATION AGREEMENT. LIKE I SAID, THERE'S NOTHING IN THAT MITIGATION AGREEMENT THAT THAT SPECIFIES DEMOLITION AND ALSO DOESN'T SPECIFY THAT THE AUTHORITY CANNOT OR WOULD NOT AT SOME POINT COME BACK. SO, HOWEVER, WE WANT TO LOOK AT IT, WHETHER THE CITY DIDN'T INCLUDE IT BECAUSE THERE WASN'T FUNDING AT THE TIME OR WHETHER THE AUTHORITY CHOSE NOT TO PURPOSELY SPECIFY THAT SO AS TO LIMIT THE AUTHORITY OR THE CITY'S ABILITY TO COME BACK AND ADDRESS THAT ISSUE. YOU HAVE TO KEEP IN MIND, AS THIS PROJECT HAS EVOLVED WITH THE HIGH SPEED RAIL AUTHORITY. NOW, NOT ONLY HAS CITY STAFF HAVE CHANGED, BUT THERE'S BEEN ALSO A LOT OF TURNOVER AND EVOLUTION IN THE STAFF AT THE HIGH SPEED RAIL AUTHORITY. SO PEOPLE THAT WERE INVOLVED EARLY ON A DECADE AGO WITH THIS PROJECT AND THAT THE CITY HAD DISCUSSIONS WITH AUNT MAY NO LONGER BE THERE AND NOT AND ALSO BOARD MEMBERS THAT WERE INVOLVED MAY NO LONGER BE THERE. AND SO YOU'RE DEALING WITH A VERY COMPLEX PROJECT THAT HAS MANY FACETS IN MANY, MANY ITEMS ASSOCIATED WITH THAT. YOU KNOW, THE HIGH SPEED RAIL AUTHORITY HAD A COMMUNITY MEETING EARLIER THIS AFTERNOON, I BELIEVE. I DON'T KNOW IF THE SPANISH VERSION IS STILL GOING ON, BUT THAT WAS SOMETHING THAT UNFORTUNATELY THE CITY WAS NOT AWARE. AND THEN OBVIOUSLY THEY HELD THAT COMMITTEE MEETING IN THE SAME TIME AS THE CITY WAS HAVING THEIR COUNCIL MEETING. AND THE TOPIC WAS IT WAS ADDRESSED SPECIFIC. THIS IS FROM A SNAPSHOT FROM THAT PRESENTATION, AND THAT IS THAT THE THE STREET FARM WORKERS HOUSING DEVELOPMENT PROJECT WAS UNDERWAY BEFORE THE HIGH-SPEED RAIL PROJECT BEGAN AND NEEDED ADDITIONAL FUNDING. YOU KNOW, IN THEORY, THE HOUSING AUTHORITY, NOT THE CITY, PER SAY, BUT THE HOUSING AUTHORITY, WAS A SEPARATE ENTITY. AND THERE WAS ALWAYS A DISCUSSION, I BELIEVE, OR THE IDEA OF RELOCATING THE THE FINAL BOROUGH HOUSING COMPLEX FROM ITS CURRENT LOCATION TO WEST SIDE OF THE TRACKS. BUT IT WAS NEVER ANYTHING THAT REALLY HAD ANY MOMENTUM, ANY ANY SERIOUSNESS, BECAUSE THE FUNDING WASN'T THERE AND THERE WASN'T A NEED AT THE TIME TO RELOCATE IT. AND IT WASN'T UNTIL THE HIGH-SPEED RAIL AUTHORITY CAME IN AND THEY WERE GOING TO HAVE SUCH A DRAMATIC IMPACT ON THE ON THE PROJECT ITSELF. AND SO THAT'S WHEN THE HIGH-SPEED RAIL AUTHORITY SAID WE WILL PROVIDE TEN MILLION DOLLARS TO RELOCATE THE RESIDENTS IN LIEU OF HAVING TO CONSTRUCT ALL THE OTHER MEASURES WE WILL BE REQUIRED TO DO AT A COST SAVINGS TO THEM. YOU KNOW, THEY CONTINUE TO WORK WITH STAFF, AND CERTAINLY THAT'S AT VARYING DEGREES OF WHAT WE WOULD CONSIDER WORKING AND COOPERATING WITH STAFF, BECAUSE CERTAINLY THERE'S FRUSTRATIONS ON BOTH SIDES WITH THE FACT THAT UNFORTUNATELY, THE CITY BELIEVES STAFF COUNCIL AND THE PUBLIC THAT IS AWARE BELIEVES THAT UNFORTUNATELY THE HIGH SPEED RAIL DOESN'T HASN'T FULFILLED AND LIVED UP TO ITS PROMISES AND AND STATEMENTS. IT HAS ASSURED. CASE IN POINT, THERE ARE BUSINESSES WITHIN AND PROPERTIES WITHIN THE CONSTRUCTION CORRIDOR THAT HIGH SPEED RAIL HASN'T COMPLETED AND HASN'T EVEN COMMUNICATED WITH THE PROPERTY OWNERS. AND YET THEY'RE EXPECTING EXPECTING TO GO OUT AND START CONSTRUCTION, STARTING CONSTRUCTION AND TAKE THOSE PEOPLE'S PROPERTIES OVER THE NEXT TWO TO THREE MONTHS IS WHEN THEY'RE HOPING TO START. BUT YET THEY HAVEN'T ACQUIRED THE RIGHT AWAY NEEDED, NOR HAVE THEY COMMUNICATED WHAT THOSE IMPACTS ARE GOING TO BE TO THOSE PROPERTY OWNERS. ONE OF THE THINGS THAT AS THIS PROJECT KIND OF EVOLVED AND THAT IS REQUIRED AS PART OF THE PROJECT, WHEN THE AUTHORITY AND THE STATE APPROVE THE IMPACT STATEMENTS AND THE IMPACT REPORTS AND IDENTIFIED AND APPROVED THE ALIGNMENTS OR THE PATH THAT THE PROJECT WAS GOING TO TAKE THAT NEEDED TO GO AND WENT TO THE US DEPARTMENT OF TRANSPORTATION, FEDERAL RAILROAD ADMINISTRATION, THEY PREPARE A REPORT REFERRED TO AS A RECORD OF DECISION RECOGNIZING THE PROJECT AND SOME OF THE THE THE ITEMS ADDRESSED AND BROUGHT UP IN THE ENVIRONMENTAL IMPACT REPORT ON THE ENVIRONMENTAL IMPACT STATEMENT. AGAIN, AS I MENTIONED, THAT IMPACT REPORT COVERS SOCIAL AND ECONOMIC AND ENVIRONMENTAL JUSTICE ISSUES. AND THIS IS DIRECTLY FROM THAT REPORT. SECTION NINE POINT SEVEN, ENVIRONMENTAL JUSTICE. FINDING THE SELECTED ALTERNATIVE WILL RESULT IN DISPROPORTIONATELY HIGH AND ADVERSE EFFECTS ON MINORITY AND LOW-INCOME POPULATIONS IN WASCO, SHAFTER, BAKERSFIELD AND OTHER RURAL AREAS OF NEW YORK AVENUE, FIFTH AVENUE, WHILE KAYNA AND. IAN CORCORAN AND THE COMMUNITY OF CHROM, SOUTH OF SHAFTER, THESE IMPACTS WOULD INCLUDE AN INCREASE IN BOTH AMBIENT NOISE LEVEL AND VIBRATION IMPACTS, DISRUPTION OF EXISTING COMMUNITIES TO RESIDENTIAL AND BUSINESS DISPLACEMENT, AND THE DISPLACEMENT OF IMPORTANT COMMUNITY FACILITIES ARE AMTRAK STATION IMPACTS TO PARK RESOURCES DECREASES IN VISUAL QUALITY. MINORITY AND LOW-INCOME POPULATIONS MAY ALSO EXPERIENCE ADVERSE CUMULATIVE [01:50:02] NOISE, VIBRATION, COMMUNITY COHESION AND ESTHETICS AND VISUAL IMPACTS. IT GOES ON TO FURTHER SAY THE PROJECT INCLUDES THE APPLICATION OF NOISE AND VIBRATION MITIGATION MEASURES TO REDUCE NOISE AND VIBRATION IMPACTS RESULTING FROM THE HIGH SPEED TRAIN OPERATIONS BY CONSTRUCTION OF SOUND BARRIERS, ACQUIRING PROPERTY EASEMENTS, INSTALLING INSULATION, AND PROVIDING THE SMOOTH RUNNING SURFACE FOR THE HIGH SPEED RAIL TRAIN AS APPROPRIATE. HOWEVER, THESE MEASURES WOULD NOT COMPLETELY ELIMINATE THE ADVERSE IMPACTS, WHICH WOULD LIKELY BE MORE SEVERE IN URBAN AREAS WHERE MINORITY AND LOW-INCOME POPULATIONS RESIDE. THINK BACK TO THAT HEAT MAP. THIS IS DIRECTLY REFERENCING OR RELATED TO OUR IMPACTS THAT WE ARE NAVIGATING, OR AT LEAST IT CERTAINLY IS THE CASE NOW. TO FURTHER HIGHLIGHT THE ISSUE OR THE POINTS AND WHAT THE CITY IS TRYING TO DO, AND THAT IS, YOU KNOW, EXECUTIVE ORDER TWELVE, EIGHT, NINE, EIGHT AND STATES, EACH FEDERAL AGENCY SHALL MAKE ACHIEVING ENVIRONMENTAL JUSTICE A PART OF ITS MISSION BY IDENTIFYING AND ADDRESSING AS APPROPRIATE, DISPROPORTIONATELY HIGH IN ADVERSE HUMAN HEALTH OR ENVIRONMENTAL EFFECTS OF ITS PROGRAMS, POLICIES AND ACTIVITIES ON MINORITY POPULATIONS AND LOW-INCOME POPULATIONS SIGNED BY THE PRESIDENT ON FEBRUARY 11, 1994, AND STILL IN EFFECT TODAY. THAT LED TO THE GREATER CONCEPT AND EMPHASIS ON ENVIRONMENTAL JUSTICE PRINCIPLES, AND THAT IS ENVIRONMENTAL JUSTICE PRINCIPLES THAT ARE FOLLOWED BY BOTH THE DEPARTMENT OF TRANSPORTATION AND THE CALIFORNIA HIGH-SPEED RAIL AUTHORITY BECAUSE THERE ARE FEDERAL RECIPIENTS OF FEDERAL FUNDING AND THE PROGRAMS THAT ARE FUNDING THE CONSTRUCTION OF THIS PROJECT. THOSE THREE PRINCIPLES IN THE FIRST ONE IS THE MORE CRUCIAL ONE THAT APPLIES TO US, AND THAT IS TO AVOID, MINIMIZE OR MITIGATE DISPROPORTIONATELY HIGH AND ADVERSE HUMAN HEALTH AND ENVIRONMENTAL EFFECTS, INCLUDING SOCIAL AND ECONOMIC EFFECTS ON MINORITY POPULATIONS AND LOW INCOME POPULATIONS, TO ENSURE THE FULL AND FAIR PARTICIPATION BY ALL POTENTIALLY AFFECTED COMMUNITIES IN THE TRANSPORTATION DECISION MAKING PROCESS TO PREVENT THE DENIAL OF A REDUCTION OR SIGNIFICANT DELAY AND THE RECEIPT OF BENEFITS BY MINORITY AND LOW-INCOME POPULATIONS. AND THAT'S THE REASON WHY THE CITY HAS BEEN VERY ASSERTIVE IN ITS POSITION THAT THE HIGH SPEED RAIL CHOSE TO COME TO WASCO. YOU KNEW WHAT THE PLANS WERE. YOU KNEW WHAT THE COMMUNITY WAS LIKE. YOU KNEW WHAT THE IMPACTS WERE. WHEN I GO BACK TO THIS, A FEDERAL RESERVE DECISION, THIS ISN'T SOMETHING THAT CAME ABOUT IN THE LAST TWO YEARS. THIS WAS PUBLISHED BY BY THE FEDERAL RAILROAD ADMINISTRATION IN JUNE OF 2014, IF I'M NOT MISTAKEN. SO THEY'VE THEY'VE KNOWN ABOUT THIS EVEN BEFORE THEY DID THE MITIGATION AGREEMENT AND THEY'RE REQUIRED BY THE EXECUTIVE ORDER AND ALL THE OTHER POLICIES THAT ARE APPLICABLE AT THE FEDERAL GOVERNMENT TO AGAIN MITIGATE THE DISPROPORTIONATELY HIGH ADVERSE IMPACTS THAT THEY'RE HAVING ON COMMUNITIES WHEN THESE PROJECTS COME TO FRUITION. NO, I KNOW THE AUTHORITY HAS BROUGHT UP THAT THE CITY HAS PROVIDED A LETTER OF SUPPORT. THEY ARE PURSUING AN INFRA GRANT WITH THE U.S. DEPARTMENT OF TRANSPORTATION THAT WOULD INCORPORATE THE DEMOLITION OF THE LABOR CAMP INTO THAT PROCESS. AND YES, THE CITY DID PROVIDE A LETTER OF SUPPORT. AND THIS IS THE MEMORANDUM THAT BRIAN KELLY, THE CEO OF HIGH SPEED RAIL AUTHORITY, PROVIDED AND MADE TO MATCH CHAD EDISON. HE'S WITH THE CALIFORNIA STATE TRANSPORTATION ADMINISTRATION. AND HE OUTLINED WHAT THE PROJECT, PURPOSE AND SCOPE IS IN THAT HIGHLIGHTED PORTION, PART OF THE PART OF THEIR GRANT APPLICATION. IT ALSO INCLUDES ADDITIONAL COST RELATED TO A SECOND PHASE OF A NEW FARM WORKER HOUSING PROJECT. THIS PHASE WOULD INCLUDE DEMOLITION OF DERELICT HOUSING, WHICH HAS ALREADY BEEN REPLACED. THE REALITY OF IS ON THE ONE HAND, THEY HAVE SAID THAT THEY'RE NOT RESPONSIBLE FOR THE DEMOLITION OF THE HOUSING PROJECT. AND YET IN THEIR OWN MEMORANDUM TO THE STATE TRANSPORTATION ADMINISTRATION, THEY'RE SAYING THAT THE DEMOLITION IS PART OF A NEW SECOND PHASE OF THE FARMWORKER HOUSING PROJECT. SO THEY'RE TRYING TO HAVE IT BOTH WAYS. AND UNFORTUNATELY, THE CITY OF WASILLA, THE COMMUNITY IS CAUGHT IN THE MIDDLE. BUT YET THIS IS THEY'RE ACKNOWLEDGING ONE THERE, THEIR INVOLVEMENT AND THEIR IMPLICATION IN THE CONDITION THAT THEY'VE RESULTED AT THE AT THE WASCO FARM LABOR HOUSING COMPLEX. AND AS I SAID, THE CITY DID PROVIDE A LITTLE SUPPORT, THAT LETTER OF SUPPORT, AS WELL AS THE MEMO THAT BRIAN KELLY SENSE IS INCLUDED IN THE COUNCIL PACKET, WILL BE AVAILABLE ON OUR CITY WEBSITE. AND CERTAINLY IT'S A VERY LENGTHY AND A VERY DETAILED LETTER OF SUPPORT [01:55:03] THAT THE CITY DID PROVIDE AND WHICH INCLUDED VARIOUS PICTURES TO DOCUMENT THE CONDITION OF THE LABOR CAMP, AS WELL AS THE LETTER THAT THE KERN COUNTY SHERIFF'S OFFICE PROVIDED IN SUPPORT OF OF THE CITY'S EFFORTS TO MITIGATE AND HAVE THE LABOR CAMP TORN DOWN. THAT IS REALISTICALLY THE ONLY WAY IN WHICH THE THE ISSUES RELATED TO BLIGHT, TO CRIMINAL ACTIVITY, TO THE BURDEN OF LAW ENFORCEMENT SERVICES WILL GET ADDRESSED. LAST FISCAL YEAR, JUNE 30TH, ENDING ON TWENTY TWENTY, YOU KNOW, OUR EXPENSES WERE SIX POINT FOUR MILLION. AND WE HAVE A 10 MILLION DOLLAR EXPENSE, WHICH IS DAMAGING TO LABOR CAMP. ESSENTIALLY, YOU'RE GOING TO PUT THE CITY BACK 10, 15 YEARS, IF NOT REALISTICALLY, POTENTIALLY FACE MAJOR CUTS TO SERVICES, AS WELL AS THE ABILITY TO EXPAND SERVICES THAT ARE NEEDED AS THE COMMUNITY CONTINUES TO GROW, NOT JUST WITH THE LABOR COUNTIES WHERE WE'RE EXPERIENCING THOSE ADVERSE EFFECTS ON THE AMTRAK SERVICE HAS ALSO BEEN IMPACTED IN THAT. EARLY ON IN THE DISCUSSIONS AT THE BEGINNING OF LAST DECADE, THE CONCEPT WAS THAT THE AMTRAK SERVICE WAS GOING TO REMAIN, IT WAS GOING TO BE PART OF AN INTEGRATED SYSTEM BETWEEN AMTRAK AND HIGH SPEED RAIL TO TO PROVIDE THAT ENTIRE RAIL SERVICE THROUGHOUT THE STATE. THEY'RE GOING TO DISCONTINUE THE AMTRAK SERVICE WANTS TO HIGH SPEED RAIL COMES ONLINE, IDEALLY WHEN THEY'RE ANTICIPATING TWENTY, TWENTY NINE. WE HAVE ALSO HAVE ON MULTIPLE FRONTS LEGISLATIVE EFFORTS, BOTH WITH SENATOR, STATE SENATOR, TODDLES OFFICE ASSEMBLY MEMBER RUDI SOLACES OFFICE. AND WE HOSTED DAVID VALADAO, OUR CONGRESSMAN HERE JUST THE OTHER WEEK. AND WE SPENT SEVERAL HOURS WITH WITH THE MAYOR, MYSELF AND A COUPLE OTHER COMMUNITY MEMBERS, BOTH TOURING THE LABOR CAMP, AS WELL AS SITTING DOWN AND HAVING A DISCUSSION WITH EVERYONE HEARING ABOUT THE IMPACTS. AND HIS OFFICE HAS BEEN ACTIVE AND AND TRYING TO EXPLORE OPTIONS. THE OTHER EFFORTS ARE ALSO RELATED TO THE CITY HAS FILED AND WAS REFERRED TO A TITLE SIX COMPLAINT. AND THAT GOES BACK TO THAT ENVIRONMENTAL JUSTICE PRINCIPLES THAT THE AND THE EXECUTIVE ORDER THAT I MENTIONED EARLIER, AND THAT IS THE TITLE SIX IS REFERRED TO AS PART OF. THE CIVIL RIGHTS ACT FROM THE 1960S, THAT ESSENTIALLY IT GOES BACK TO THE FACT THAT FEDERAL AGENCIES AND FEDERAL FUNDED PROGRAMS HAVE TO ADHERE TO THOSE ENVIRONMENTAL [02:00:01] JUSTICE PRINCIPLES AND ADDRESS AND NOT CREATE ADVERSE OR NEGATIVE IMPACT THAT THEIR FUNDING. AND SO THE CITY DID FILE A COMPLAINT BECAUSE WE WERE BEING NEGATIVELY IMPACTED. AND AT THE TIME WE WEREN'T GETTING ANYWHERE WITH THE HIGH SPEED RAIL AUTHORITY. AND SO THAT PRESERVED A PROCESS THAT WOULD REQUIRE THE AUTHORITY TO TO DILIGENTLY ADDRESS IT. THAT PROCESS IS EXPECTED TO EXPIRE OR GET A FORMAL RESPONSE BACK FROM THE AUTHORITY LATER THIS MONTH ON THEIR POSITION BASED ON WHAT'S BEEN SUBMITTED. THE TITLE IX COMPLAINT IS AVAILABLE ON OUR WEBSITE AS WELL. AND THEN THE OTHER PART OF IT IS JUST A GREATER COMMUNITY AWARENESS. OUR SHERIFF'S DEPUTIES ARE FREQUENTLY OUT AT THE LABOR CAMP RESPONDING FOR FOUR CALLS FOR SERVICE RELATED TO TRESPASSING, SUSPICIOUS VEHICLES, SUSPICIOUS INDIVIDUALS. THEY FREQUENTLY RECOVER ITEMS THAT HAVE BEEN STOLEN FROM BUSINESSES AND RESIDENCES THROUGHOUT THE COMMUNITY. WALKING THROUGH THE COMPLEX, THERE'S VISIBLE SIGNS OF OF RIVAL GANGS THAT ARE IN AND OUT OF THE LABOR CAMP IN THAT COMPLEX. AND EVEN THOUGH WE HAVE COMPLETED AND CONSTRUCTED A FENCE AROUND THE PERIMETER, UNFORTUNATELY, THERE ARE THESE INDIVIDUALS AND CRIMINALS ARE CUTTING THOSE FENCES AND AND AND MAKING THEIR WAY INSIDE. SO THE CITY IS SPENDING MONEY ON TOP OF THE CONSTRUCTING THE FENCE. BUT WE'RE SPENDING MONEY AND TIME AND REPAIRING THOSE SECTIONS AND ALSO JUST TRYING TO STAY AFLOAT AND TRYING TO NOT ALLOW THE PROBLEM TO GET WORSE THAN IT ALREADY IS. YOU KNOW, ONE OF THE THINGS THAT I WANTED TO ILLUSTRATE IS THE FACT THAT, YOU KNOW, OBVIOUSLY MOST OF THE STUFF I BROUGHT IS RELATED TO THE FEDERAL GOVERNMENT AND THE DEPARTMENT OF TRANSPORTATION, FEDERAL RULES THAT APPLY TO TITLE SIX PROCESS AND THE ENVIRONMENTAL REVIEW. SO IN THAT INSTANCE, THE US DEPARTMENT OF TRANSPORTATION IS REQUESTING THE STATE OF TEXAS TO TO HALT THEIR PROJECT WHILE THEY LOOK INTO AND REVIEW THE ENVIRONMENTAL AND SOCIAL JUSTICE ISSUES THAT HAVE BEEN RAISED. BUT YET HERE IN CALIFORNIA AND THE ISSUES THAT WE'VE RAISED, WE'RE JUST GETTING STEAMROLLED. AND SO THAT'S A LOT OF INFORMATION, I UNDERSTAND. AND SO WHEN THE PROJECT CAME IN AND THE THAT COMMUNITY THAT THE LABOR CAMP WAS SPECIFICALLY IDENTIFIED WITHIN THE IMPACT STATEMENTS OF THE HIGH SPEED RAIL AUTHORITY, IT IN SHOWING ON THE MAP HERE, THE AUTHORITY HAD TO DO SOMETHING AND THE AUTHORITY WAS FORCED TO EITHER CONSTRUCT EXPENSIVE MITIGATION MEASURES AND OR WHAT THEY CHOSE WAS TO RELOCATE THE RESIDENTS TO A NEW COMPLEX. WITHOUT THE PROJECT COMING TO TO WASCO, THE FARM LABOR HOUSING COMPLEX WOULD STILL HAVE REMAINED. A RESIDENCE WILL STILL REMAIN THERE, AND IT WOULD HAVE STILL BEEN A WISH FOR THE COMMUNITY TO MOVE FORWARD IN. BUT THE AUTHORITY IDENTIFIED IT AS AN ENVIRONMENTAL JUSTICE ISSUE THAT WAS CHEAPER FOR THEM TO RELOCATE THEM THAN IT WOULD BE FOR THEM TO CONSTRUCT THOSE MEASURES. TO PUT IN PERSPECTIVE IN TERMS OF, I GUESS, THE THE FINANCIAL CONUNDRUM THE AUTHORITY WAS IN THE ORIGINAL CONCEPT FOR THE HIGH SPEED RAIL WAS WASN'T TO BE AT GRADE CROSSING, WHICH WHICH MEANS THE TRACKS WEREN'T GOING TO BE CONSTRUCTED AT GROUND LEVEL. IT WAS ACTUALLY GOING TO BE AN ELEVATED PLATFORM. BUT AT ONE POINT, AS THIS PROJECT WAS BEING DESIGNED AND THAT'S THE THE MORE COMPLEX PART OF THIS IS THAT IT'S REFERRED TO AS A DESIGN BUILD, WHICH MEANS WHEN THEY START WHEN THEY START TURNING DIRT, WHEN THEY START MOVING, HOW THEY'RE DOZERS MOVING FORWARD, THEY DON'T HAVE A COMPLETE SET OF PLANS. THEY'RE BUILDING THIS AS THEY GO ON INCH BY INCH. AND SO FROM THE CITY AND ALL THE CITIES IS THAT'S THE BIGGEST STRUGGLE BETWEEN THE CITY AND THE COUNTY, IS THAT WE DON'T HAVE A COMPLETE SET OF PLANS FROM WHEN THEY INITIALLY CONCEPTUALIZE THIS PROJECT THAT THEY HAVE HAD HERE, TOO, BECAUSE IT WAS TOO EXPENSIVE TO BUILD THE THE ELEVATED TRACKS. AND THEN OVER TIME, IT WAS THOSE UNFORTUNATELY, ALL THOSE SMALL PIECES AND COMPONENTS OF THE PROJECT THAT RESULTED IS TOO EXPENSIVE TO THIS. SO WE'RE GOING TO DO THIS IS TOO EXPENSIVE TO THAT. SO WE'RE GOING TO SUBSIDIZE IT WITH THIS OR REPLACE IT WITH THAT. AND SO, UNFORTUNATELY, I'M GOING TO BE BLUNT AS AS THIS PROJECT HAS EVOLVED, THEY'VE GOTTEN CHEAPER, THEY'VE GOTTEN MORE STINGY. THEY FAILED TO ADEQUATELY INVEST AND PLAN FOR THIS. I MEAN, THEY'RE JUST CHEAP AND THEY'RE REFUSING TO TAKE RESPONSIBILITY FOR THEIR OWN ACTIONS. REALIZING THAT'S COMING TO WASCO, I BELIEVE THAT THEY UNFORTUNATELY BELIEVE THAT WE WERE GOING TO BE SILENT AND WE WERE JUST GOING TO BE STEAMROLLED AND NOT OPPOSE OUR EFFORTS.
